1. Acknowledgment of Risks
I, the undersigned, acknowledge that participating in recreational boating, paddleboarding, and related water sports involves inherent risks, including but not limited to:
Drowning, capsizing, or falling into water
Collision with other boats, people, or objects
Exposure to sun, wind, marine life, or weather changes
Equipment failure or improper use
I affirm that I am physically fit and capable of safely operating and/or participating in the use of the rental equipment.
2. Voluntary Assumption of Risk
I voluntarily assume full responsibility for all risks of injury, illness, damage, loss, or death that may occur during my participation, whether caused by negligence of Wet Willy’s Boat Rental, LLC, its owners, staff, or otherwise.
3. Release of Liability
In consideration for being allowed to rent equipment and participate in related activities, I hereby:
Release, waive, discharge, and covenant not to sue Wet Willy’s Boat Rental, LLC, Will Rankin (President), their employees, agents, representatives, successors, or assigns, from any and all liability, claims, demands, or causes of action arising from my use of rental equipment or participation in water-related activities.
4. Equipment Responsibility
I agree to:
Operate the rented equipment safely and in accordance with all local laws and regulations.
Return all equipment in the same condition in which it was received.
Pay for any loss or damage to equipment beyond normal wear and tear.
5. Alcohol and Drug Use
I affirm that I am not under the influence of alcohol, drugs, or any other substance that could impair my ability to safely participate in water activities.
6. Life Jacket Acknowledgment
I understand that wearing a U.S. Coast Guard-approved personal flotation device (PFD) is required by law and is provided with each rental. I acknowledge that I have been offered and instructed to wear a PFD at all times while on the water.
7. Minors and Guests
If I am signing on behalf of a minor or group, I take full responsibility for their safety, conduct, and adherence to this agreement.
8. Governing Law
This agreement shall be governed by the laws of the State of Alabama. Any legal dispute shall be resolved in Baldwin County, Alabama.
9. Severability
If any part of this agreement is held unenforceable, the remainder shall remain in full force and effect.
10. Acknowledgment
I have read this entire agreement and understand that by signing it, I am waiving certain legal rights, including the right to sue. I sign this waiver freely and voluntarily.
